Guy got shot in the belly last week in my 'burg outside a convenience store. Friends put the dude in a truck and headed for the hospital. Cops arriving on scene located the shooter, who told them, "I shot him, but it was in self-defense." Cops interviewed all parties and witnesses. It was determined the dude had brandished a machete and that indeed the guy had shot him in self-defense. No charges filed. Case closed.

Didn't result in a death, but here's a video that occurred in the area just a few nights ago. It has received a great deal of "attention" and debate. This is an officer with the Salina Police Department - the same department that arrested and incarcerated my wife without probable cause, and who then found her guilty of a crime only after the prosecutor advised the jury in his closing arguments that she had not proven that she did not commit the crime for which she as accused. This type of heavy handedness is not at all a first for SPD. A bunch of years ago, they received national attention when they were sued and found guilty of unnecessary force. This officer gives this guy all of six seconds to comply with his request before tasing him. The driver was making no aggressive moves toward the officer or anyone. He simply asked the officer why he was being detained - something each of us has the right to do.

In the interest of full disclosure, he had been directed to pull over in a seatbelt check lane when he was observed not wearing his belt. The cell phone was lying on the console and recorded the interaction.

Here is one comment from the author of the video that explains why the driver was reaching for the gear shift.

This has been edited considerably for time. There was a long wait between the 2 visits to the window... Nothing important is cut.

The license did come back as suspended in the system, though tracking it back the next couple days as to why, came back with a couple different results until the supposed correct one was found.

The cop wasn't making shit up, they were certainly looking to make some trouble... since they likely perceived as tattooed thugs or whatever. "

"So, to secure a manual vehicle while it's running, while processing this info of... fuck, I'm being arrested right now, what the fuck for? Ok... seat belt is on, neutral... running truck, gotta turn it off, and it needs to not roll away, oh shit I'm being fucking tasered! That's 5 seconds of a slightly surprised thought process of someone with absolutely no idea they're doing something oh so terribly wrong."

Frankly, I have a problem with several things here. First, the officer's language. If you're gonna refer to my ass in that tone of voice, expect me to lose my sense of total cooperation. It's obvious the guy had an attitude and, in that job, you MUST maintain your calm to keep a situation from going bad, as this one did.

Second, they had the guy's name, address, and everything they needed. Even if he drove off, big deal. Get him later.

Third, since when is using a taser gun an accepted means of forcing compliance? As a means of non-lethal personal defense? Yes. This? Unacceptable.

Fourth, the diver was in no way obligated to answer the officer's intrusive questions, especially since he was not, at the time, under arrest.

Even if the driver was being difficult, it is incumbent upon the officer to maintain his sense of calm rather than hauling off and tasing someone, especially under the pretense that the guy was trying to drive away when, in fact, he was simply trying to secure his vehicle properly.

Here's my take on law enforcement anymore. When we started this country, there were but a few things you could not do. They were called the Ten COmmandments. Since then, a bojillion laws have been passed, and each one is another right we have surrendered to the government. The government enforces those rules and the deprivation of our rights through the police. With the attitude of a growing number of people toward the government today, and as close as this country is to boiling over. I would be vary careful how I carry myself if I were wearing a badge today. I sure as hell would make sure that I didn't pull over enough cars on a check lane like this that the occupants of those vehicles outnumbered the officers lest there might be an incident if something like this happened.

I think at the very least the officer should lose his job. He didn't handle THAT situation well at all, so one would think that he wouldn't be able to handle a REAL situation at all.

I think there's probably grounds for a winnable lawsuit too. Especially if that video shows that he wasn't trying to flee.

Seat belt check lane? Really? I've never heard of that...ever.
And, I (obviously) don't agree with it. I don't agree with any unwarranted stops.
If you catch me or witness me breaking the law...stop me.
Don't stop me to SEE if I'm breaking the law.
Haven't some states found these checkpoints to be unconstitutional?

Now, this part, I agree with. Guy asks question, in a moderately reasonable way. Seems too quick on the trigger just because the "turd" doesn't comply with demands? After all, he is just sitting there, hand on the gearshift or not. He sure as hell can't run over the cop standing by the window and presumably, there are vehicles in front of him in the seatbelt lane?

This is kinda like the chick cop that killed a kid who answers the door with a game controller device in his hand.

As far as I am concerned, it's the cop that needs to exercise the self control. There are lots of people, (the public) that react differently and resorting to a taser is way down the list of acceptable responses, in response to those unpredictable responses.

Hell yeah, Duck. Salina is BIG on seatbelt violations. Last Christmas, all hell broke loose when the Salina PD was found putting an undercover cop dressed as Santa Claus at the exit of the WalMart parking lot handing out candy canes. A car would stop to get their candy cane from Santa Claus and, if anyone wasn't wearing a belt, Santa would radio ahead a couple blocks where a gauntlet of officers were waiting with ticket books in hand. They are, hands down, the most chicken shit department in the country.

As for the "turd's" attitude, yeah, he was a bit snarky in his remarks, but you know what? That's the nature of people when you deal with them as a law enforcement officer. People tend to get "moody" when the Po-po shows up and starts knocking heads. If you don't like people not being overwhelmingly happy to see you, maybe it's not the job for you. Unless, of course, you just have it in your head that you can just tase them to knock the ones in line that piss you off. Ten seconds to judge them and execute the sentence, then ride the lightning! I didn't stay in law enforcement because I very quickly began to get very cynical toward people - the ol' "In God we trust. Everyone else gets run through NCIC" mentality - and I did not like the cynical asshole I was becoming. I was at a standoff at a four-plex apartment building and we had two ambulances there on stand by in case things went to shit. I was 23 years old and scrawny as hell. They put me on the back door on my own when the subject that had barricaded himself threw the backdoor open and started opening the screen door. All I could think to do was look him in the eye, go into my shooting stance and unclip the strap on my holster holding my S&W .357. With my right hand on the grip, I began to lift it from the holster and pointed my left finger at him and told him that if he was coming out, he was coming through the front door like he'd been told to do. I must have called his bluff better than he called mine because he took one look at my hand that, thank God wasn't shaking, and slammed the door in my face. LOL The director of EMS was there and saw me "in action" LOL and said he liked the way I handled myself and he wanted me on his department. The rest is history. Turns out that people are literally dying to meet the medics when they call 911. Only had a couple instances where folks weren't happy to see us roll up. That was my niche, rather than being an asshole and telling people to get their ass out of their vehicle, only to be surprised when they demonstrated their displeasure and lack of appreciation for the way they were being treated.
